Page One Gallery – Artist & Gallery Consignment Terms and Conditions
These Terms and Conditions (“Agreement”) apply to all artists and galleries (“the Consignor”) submitting artworks for inclusion in Page One Gallery exhibitions, auctions, or promotional programs (“the Event”).
By submitting or applying to consign artworks, you acknowledge that you have read, understood, and agreed to the following terms:
1. Consignment Overview
1.1 Upon acceptance, artworks are considered on loan to Page One Gallery for the purpose of marketing, exhibition, and sale during the Event.
1.2 Ownership of the artwork remains with the Consignor until the sale is completed and payment is received in full from the buyer.
1.3 Artworks generally remain in the Consignor’s possession unless specifically requested for promotional or display purposes.
2. Submission & Selection
2.1 Submission of artworks does not guarantee inclusion. All works are subject to curation and approval by Page One Gallery.
2.2 The Consignor agrees to provide accurate details, clear images, and truthful descriptions of artworks.
2.3 Accepted artworks will be listed and promoted as part of the Event, under the agreed terms below.
3. Exclusivity
3.1 Once accepted, the artwork must not be listed for sale elsewhere (including online platforms, other galleries, or private sales) until the Event has concluded.
3.2 If the artwork sells elsewhere during the exclusivity period, the Consignor must immediately notify Page One Gallery. A withdrawal fee or administrative charge may apply if the sale disrupts promotion or catalogue listings.
4. Commission & Payment
4.1 Page One Gallery retains a commission on all sold artworks.
4.2 Commission rates vary depending on the artwork’s value, typically ranging between 10% and 30%.
4.3 Payment of proceeds to the Consignor will be made within 14 business days after the buyer’s payment has cleared.
4.4 Any payment disputes must be raised in writing within 7 days of receiving payment.
5. Pricing & Reserves
5.1 The Gallery and the Consignor will agree on a listing price or reserve prior to the Event.
5.2 Page One Gallery may recommend a price range to ensure consistency and competitive bidding, but final approval rests with the Consignor.
6. Shipping, Handling & Delivery
6.1 Artworks will remain in the Consignor’s possession unless otherwise arranged for promotion, display, or photography.
6.2 If sold, the Consignor is responsible for securely packaging and shipping the artwork to the buyer.
6.3 Shipping costs are to be paid by the buyer, unless otherwise agreed.
6.4 The Consignor agrees to ship sold works within 7 business days of being notified of a sale and to provide a valid tracking number.
6.5 Page One Gallery is not responsible for any damage or loss during transit.
7. Promotion & Use of Images
7.1 By submitting artwork, the Consignor grants Page One Gallery permission to use images, videos, and descriptions of the artwork for promotional, marketing, and archival purposes.
7.2 Promotional materials may reference both the artist and any representing gallery, reflecting the collaboration as a joint partnership.
7.3 This license is royalty-free and extends to all marketing formats including digital, print, and social media.
8. Liability & Insurance
8.1 Page One Gallery will take all reasonable care in handling artworks when in its possession, but accepts no responsibility for accidental loss, theft, or damage to artworks that remain with the Consignor.
8.2 The Consignor is encouraged to maintain their own insurance coverage for the duration of the consignment period.
9. Unsold Works
9.1 If an artwork remains unsold, the Consignor may choose to:

Keep it listed for future events; or

Withdraw it at no charge, provided written notice is given within 7 days after the Event’s conclusion.
9.2 The Gallery may retain artwork information and images for archival or promotional purposes unless otherwise requested in writing.
10. Event Changes
10.1 Page One Gallery reserves the right to adjust event dates, formats, or platforms as necessary.
10.2 The Consignor will be notified of any major changes as soon as reasonably possible.
11. Legal Agreement
11.1 By submitting artwork for consideration, the Consignor agrees to these Terms and Conditions and acknowledges that this document constitutes a binding agreement.
11.2 This Agreement is governed by the laws of the State of Victoria, Australia, and any disputes shall be resolved within that jurisdiction.
